Terms of Use

These Terms of Use ("Terms") govern access to and use of the website located at eltrivok.site (the "Site") and the enquiry, subscription and information services made available through it by Mabaso & Vorster Financial Consulting (Pty) Ltd (Proprietary Limited (Pty Ltd)), trading as Mabaso & Vorster Financial ("the Firm", "Mabaso & Vorster Financial", "we", "us" or "our"). These Terms apply to every person who accesses the Site, submits information through the contact form, subscribes to the email list, or otherwise interacts with the Site, and they take effect from 2026. By using the Site, the user ("you" or "the user") accepts these Terms in full. If the user does not accept these Terms, the user must not use the Site.

1. Identity and Status of the Firm

1.1 The Site is operated by Mabaso & Vorster Financial Consulting (Pty) Ltd, a Proprietary Limited (Pty Ltd) registered in the Republic of South Africa under registration number 0701787155, with its registered office and principal place of business at 47 Biccard Street, Polokwane Business Park, 0700 Polokwane, South Africa.

1.2 The Firm may be contacted at [email protected] or by telephone on +27 15 176 5600 in respect of any query arising from these Terms or from the use of the Site.

1.3 Nothing on the Site constitutes, and nothing in these Terms shall be construed as constituting, the rendering of financial advice, a financial services provider licence disclosure, or a substitute for any statutory disclosure required under the Financial Advisory and Intermediary Services Act 37 of 2002 or any successor legislation. Where the Firm renders financial services requiring authorisation under applicable South African law, such services are governed by separate engagement documentation and disclosure furnished directly to the client, and not by these Terms.

2. Nature and Purpose of the Site

2.1 The Site is provided as an informational and business-development resource for Mabaso & Vorster Financial's financial consulting services. It describes the Firm's areas of practice, permits prospective and existing clients to make contact by way of a contact form, and permits interested persons to subscribe to receive periodic communications by email.

2.2 Content published on the Site, including any commentary on financial markets, regulatory developments, or general guidance, is provided for general informational purposes only. It does not constitute personalised financial advice and should not be relied upon as such. Any person requiring advice tailored to their particular financial circumstances should engage the Firm directly through a formal client engagement process.

3. The Contact Form

3.1 The Site provides a contact form through which a user may submit an enquiry to the Firm. The user warrants that any information submitted through the contact form, including the user's name, email address, telephone number and the content of the enquiry, is accurate, current, and submitted by the user in respect of the user's own affairs or with the authority of the person on whose behalf it is submitted.

3.2 Submission of the contact form does not, of itself, create a client relationship, a mandate, or any contractual relationship between the user and the Firm. A client relationship arises only once the Firm has expressly agreed, in writing, to act on the user's behalf and the applicable terms of engagement and any regulatory disclosures have been furnished and accepted.

3.3 The Firm will endeavour to respond to enquiries submitted through the contact form within a reasonable time, but does not warrant any particular response time and accepts no liability for delay in responding.

4. Email Subscription

4.1 A user may subscribe to receive email communications from the Firm, including newsletters, market commentary, and notices of services, by submitting an email address through the subscription facility on the Site.

4.2 By subscribing, the user consents to receive such communications from the Firm. The user may withdraw this consent and unsubscribe at any time, either by using the unsubscribe mechanism contained in any such email or by contacting the Firm at [email protected]. Withdrawal of consent does not affect the lawfulness of communications sent prior to withdrawal.

4.3 The Firm's collection and processing of email addresses and related personal information for purposes of the subscription service is further governed by the Firm's Privacy Policy, which forms part of, and should be read together with, these Terms.

5. Intellectual Property

5.1 All content published on the Site, including text, graphics, logos, the Mabaso & Vorster Financial name and mark, layout, and underlying source code, is the property of the Firm or its licensors and is protected under the Copyright Act 98 of 1978 and applicable trade mark law of the Republic of South Africa.

5.2 No part of the Site may be reproduced, distributed, modified, or exploited for commercial purposes without the prior written consent of the Firm, save that a user may view, download, and print extracts of the Site for personal, non-commercial reference, provided that no proprietary notice is removed or altered.

6. Acceptable Use

6.1 The user undertakes not to use the Site in any manner that is unlawful, fraudulent, or harmful, or that infringes the rights of the Firm or any third party.

6.2 The user undertakes not to introduce viruses, malicious code, or any technology designed to interfere with the proper functioning of the Site, and not to attempt to gain unauthorised access to the Site, the server on which it is hosted, or any database or system connected to it.

6.3 The user undertakes not to submit, through the contact form or otherwise, any content that is defamatory, unlawful, threatening, or that infringes the intellectual property or privacy rights of any third party.

7. No Financial Advice Disclaimer

7.1 To the fullest extent permitted by law, the Firm makes no representation or warranty, whether express or implied, as to the accuracy, completeness, or currency of any information published on the Site.

7.2 Financial markets and regulatory frameworks change, and information published on the Site may become outdated without notice. Reliance on any such information is at the user's own risk, and the Firm accepts no liability for any loss arising from such reliance, save to the extent that liability cannot lawfully be excluded under the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 where applicable.

8. Limitation of Liability

8.1 The Firm shall not be liable to the user for any indirect, incidental, special, or consequential loss or damage arising out of or in connection with the use of, or inability to use, the Site, whether such liability arises in contract, delict, or otherwise, save where such exclusion is not permitted by law.

8.2 Nothing in these Terms shall be interpreted so as to exclude or limit liability for gross negligence, fraud, or wilful misconduct on the part of the Firm, or any liability that may not lawfully be excluded or limited under South African law.

8.3 The Firm does not warrant that the Site will be available on an uninterrupted or error-free basis, and accepts no liability for any loss arising from downtime, technical failure, or unavailability of the Site.

9. Links to Third-Party Sites

9.1 The Site may contain links to third-party websites provided for the user's convenience. The Firm does not control and is not responsible for the content, privacy practices, or availability of any third-party website, and the inclusion of any such link does not imply endorsement by the Firm.

10. Amendment of These Terms

10.1 The Firm reserves the right to amend these Terms at any time, in its sole discretion, to reflect changes in the Firm's services, applicable law, or operational requirements. The version of these Terms published on the Site at the time of use shall govern that use.

10.2 Material amendments affecting registered subscribers will, where reasonably practicable, be communicated by email to the address provided at subscription.

11. Governing Law and Jurisdiction

11.1 These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.

11.2 The user consents to the non-exclusive jurisdiction of the courts of the Republic of South Africa in respect of any dispute arising out of or in connection with these Terms or the use of the Site.

12. Severability

12.1 If any provision of these Terms is found by a competent court or tribunal to be unlawful, invalid, or unenforceable, that provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.
